1. Introduction
Welcome to Tappy! These Terms of Service ("Terms") govern your use of the Tappy platform, website, and services (collectively, the "Service") operated by Teach Tappy ("we," "us," or "our"). By accessing or using our Service, you agree to be bound by these Terms. If you disagree with any part of the Terms, please do not use our Service.
2. Definitions
Throughout these Terms, we'll use the following terminology:
- "Service" refers to the Tappy platform, including all content, features, and functionality offered.
- "User" refers to individuals who access or use the Service, including both Guest Users and Premium Users.
- "Guest User" refers to users accessing the limited free features of the Service without a paid subscription.
- "Premium User" refers to users with an active paid subscription to the Service.
- "AI Tutor" refers to our artificial intelligence-powered tutoring system that provides educational assistance and feedback.
- "Content" refers to text, graphics, images, music, software, audio, video, information, or other materials that may be viewed or accessed through the Service.
3. User Accounts
3.1 Guest Access
You may access certain limited features of our Service as a Guest User without creating an account. Guest Users have access to:
- A limited number of math questions (15 total)
- Basic visualization features
- Limited voice tutoring capabilities (up to 30 minutes)
- Basic learning style detection
3.2 Age Requirements and Account Creation
Age Requirement: You must be at least 13 years of age to create an individual account or use our Service. If you are under 13, you may only access the Service through a school-administered account where your school has provided consent, or with verifiable parental consent.
To access the full features of our Service, you must create a Premium User account by providing certain information and paying the subscription fee. By creating an account, you represent that:
- You are at least 13 years of age, or
- You are accessing the Service through a school-administered account, or
- You have verifiable parental consent to use the Service
If you are creating an account on behalf of a minor, you represent that you are the parent or legal guardian of that minor and consent to these Terms on their behalf.
3.3 Account Responsibilities
You are responsible for:
- Maintaining the confidentiality of your account login information
- All activities that occur under your account
- Notifying us immediately of any unauthorized use of your account
- Ensuring that any content you submit is accurate and appropriate
We reserve the right to disable any user account if, in our opinion, you have violated any provision of these Terms.
4. Subscription and Billing
4.1 Subscription Terms
Premium User access requires a paid subscription. The current subscription fee is $10 per year, which provides access to all Premium features, including:
- Unlimited math questions
- Full visualization suite
- Full voice tutoring access (no additional charge)
- Learning style adaptation
- Personalized learning portfolio
- Token economy participation
- Progress tracking across sessions
4.2 Billing and Renewal
Upon subscribing, you authorize us to charge the applicable subscription fee to your selected payment method. Subscriptions automatically renew for additional periods equal to the original subscription term unless canceled before the renewal date.
4.3 Refund Policy
We offer a 30-day money-back guarantee for new Premium subscriptions. If you are not satisfied with the Service, you may request a full refund within 30 days of your initial subscription purchase. Refund requests after this period will not be honored.
5. AI Tutoring System
5.1 AI System Description
Tappy provides an AI-powered tutoring system that uses advanced reinforcement learning technology to provide personalized tutoring. Our AI Tutor, named Mira, is designed to:
- Answer mathematics-related questions
- Provide step-by-step explanations
- Generate visual representations of mathematical concepts
- Adapt to your learning style and preferences over time
- Offer voice-based interaction and tutoring
5.2 Limitations of AI Tutoring
While our AI Tutor strives to provide accurate and helpful educational content, you acknowledge that:
- The AI Tutor may occasionally provide incorrect information or make errors
- The Service is designed as a supplementary educational tool and is not a replacement for professional education
- Results may vary based on individual learning needs and engagement
- The AI Tutor's capabilities are limited to mathematics and related subjects
5.3 Appropriate Use of AI Tutor
You agree to use the AI Tutor responsibly and in accordance with these Terms. Specifically, you agree not to:
- Attempt to manipulate the AI Tutor into generating harmful, misleading, or inappropriate content
- Use the AI Tutor for cheating on formal assessments or academic dishonesty
- Share or export the AI Tutor's responses for unauthorized distribution
- Reverse engineer or attempt to extract the underlying models or algorithms
6. Voice Tutoring Features
Our Service includes voice-based tutoring capabilities using the LiveKit integration. By using the voice features:
- You consent to our processing of your voice input for the purpose of providing tutoring services
- You understand that voice sessions may be temporarily stored to improve service quality
- Guest Users have limited voice tutoring time (30 minutes), while Premium Users have unlimited access
- You acknowledge that voice features require appropriate hardware and internet connectivity
7. Acceptable Use
You agree not to:
- Use the Service for any illegal purpose or in violation of any laws
- Violate or infringe other people's intellectual property, privacy, or other rights
- Interfere with or disrupt the Service or servers or networks connected to the Service
- Attempt to gain unauthorized access to parts of the Service not intended for public access
- Use the Service to generate content that is harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable
- Impersonate any person or entity or falsely state or misrepresent your affiliation with a person or entity
- Engage in any activity that could disable, overburden, or impair the Service
- Use any automated means or interface not provided by us to access the Service
- Share your account credentials with others or allow multiple users to access the Service through a single account
8. Intellectual Property
8.1 Our Intellectual Property
The Service and its original content, features, and functionality are owned by Teach Tappy and are protected by international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws. This includes our AI tutoring technology, branded as Morpheus RL.
8.2 License to Use
We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for your personal, non-commercial purposes in accordance with these Terms.
8.3 User-Generated Content
By submitting content to the Service (such as questions, notes, or voice recordings), you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, adapt, publish, and display such content in connection with providing and improving the Service.
9. Data and Privacy
Your use of the Service is also governed by our Privacy Policy, which is incorporated by reference into these Terms. Our Privacy Policy outlines how we collect, use, and share your information.
Key aspects of our data practices include:
- We use cookies and localStorage to operate our website and analyze website traffic
- Questions and voice tutoring usage are tracked for both Guest and Premium Users
- We use internal analytics (no third-party tracking services) to improve the Service
- Guest User data can be linked to Premium User accounts when upgraded
- AI interaction data may be used to improve our tutoring models
- Voice inputs are processed for tutoring purposes and may be temporarily stored
- We comply with children's privacy protection laws, including COPPA for users under 13
- We implement end-to-end encryption for all student-tutor conversations
- We do not sell your personal information to third parties
Please note that the Service is designed primarily for educational purposes, and we prioritize the privacy and safety of all users, especially students and minors. We implement appropriate safeguards for all data collection and processing activities.
9.1 Data Security
We use industry-standard security measures to protect your personal information, including:
- End-to-end encryption for all tutor-student conversations
- Secure data storage with encryption at rest
- Regular security assessments and monitoring
- Limited employee access to personal information
- Secure data retention and deletion practices
9.2 Parental Controls and Privacy
For users under 13, we require parental consent in accordance with the Children's Online Privacy Protection Act (COPPA). Parents of children under 13 can:
- Review their child's personal information
- Request deletion of their child's personal information
- Refuse to allow further collection or use of their child's information
Parents can view learning metrics and progress information, but we strictly protect the privacy of conversations between students and the AI tutor, sharing only learning metrics and not conversation content.
9.3 Educational Institution Terms (FERPA Compliance)
When our Service is used by educational institutions (schools, school districts, or other educational agencies), the following additional terms apply:
- School Official Designation: We act as a "school official" under FERPA with a legitimate educational interest in student education records.
- Educational Purpose: We use student data solely for the educational purposes for which it was provided and as directed by the educational institution.
- No Secondary Use: We do not use student education records for advertising, marketing, or to create advertising profiles.
- Data Return/Deletion: Upon termination of services, we will return or delete student education records as directed by the educational institution.
- Subcontractor Compliance: Any subcontractors who access student data are bound by the same data protection obligations.
- Breach Notification: We will notify the educational institution of any data breach affecting student records within 72 hours of discovery.
Educational institutions using our Service agree to:
- Provide appropriate notice to parents about the use of our Service
- Ensure compliance with applicable student privacy laws
- Authorize us to access student data for the purpose of providing educational services
- Manage user accounts and access permissions for their students and staff
10. Termination
We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including, without limitation, if you breach these Terms.
Upon termination, your right to use the Service will immediately cease. If you wish to terminate your account, you may simply discontinue using the Service or contact us to request account deletion.
11. Limitation of Liability
In no event shall Teach Tappy, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:
- Your access to or use of or inability to access or use the Service
- Any conduct or content of any third party on the Service
- Any content obtained from the Service
- Unauthorized access, use, or alteration of your transmissions or content
- Errors or inaccuracies in the AI Tutor's responses or educational content
- Decisions made based on information provided by the AI Tutor
12. Disclaimer
Your use of the Service is at your sole risk. The Service is provided on an "AS IS" and "AS AVAILABLE" basis. The Service is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance.
While we strive to provide accurate educational content, Teach Tappy does not warrant that the Service's content will be error-free or that any errors will be corrected. Academic results depend on many factors outside our control, and the AI Tutor is a supplementary learning tool, not a replacement for professional education.
13. Product Changes and Modifications
13.1 Right to Modify the Service
We reserve the right to modify, suspend, or discontinue the Service (or any part thereof) at any time, with or without notice to you. This includes, but is not limited to:
- Adding, altering, or removing features or functionality
- Changing the user interface or experience
- Updating the AI tutoring algorithms and models
- Modifying voice tutoring capabilities and limitations
- Changing the number of free questions available to Guest Users
- Adjusting performance, availability, or methods of access
13.2 Continuity of Service
While we strive to provide uninterrupted service, you agree that:
- We may perform maintenance that could affect Service availability
- We may upgrade, downgrade, or replace the technology, infrastructure, or features without notice
- There is no guarantee of continuous, uninterrupted access to the Service
- The quality, features, and functionality of the Service may vary over time
13.3 Voice Features
With respect to voice tutoring features specifically:
- We may modify, limit, or expand voice functionality at any time
- Third-party voice processing technologies (such as LiveKit) may be changed, replaced, or discontinued
- The availability, quality, or response time of voice features may vary
- We make no warranties regarding the accuracy of voice transcription or voice recognition
- Voice minute limitations for Guest Users may be adjusted at our discretion
13.4 No Refunds for Product Changes
You acknowledge and agree that:
- Changes to the Service do not entitle you to any refund (except as expressly provided in Section 4.3)
- Features available at the time of your subscription may be modified or removed without compensation
- We are not liable for any loss or damage that may result from changes to the Service
- You are subscribing to the Service as it evolves over time, not to any specific feature set
By continuing to use our Service, you acknowledge that the nature and form of the Service may change without prior notice to you and without any liability to Teach Tappy.
14. Changes to Terms
We reserve the right to modify or replace these Terms at any time at our sole discretion. We will provide notice of any significant changes by posting the new Terms on this page and updating the "Effective Date" at the top.
By continuing to access or use our Service after any revisions become effective, you agree to be bound by the revised Terms. If you do not agree to the new Terms, you are no longer authorized to use the Service.
15. Governing Law
These Terms shall be governed and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.
Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.
16. Additional Provisions
16.1 Force Majeure
We will not be liable for any failure or delay in performance resulting from causes beyond our reasonable control, including but not limited to acts of God, natural disasters, pandemic, war, terrorism, riots, civil unrest, government action, labor disputes, or Internet service disruptions.
16.2 Assignment
You may not assign these Terms or any rights or obligations hereunder without our prior written consent, and any attempted assignment in violation of this provision is null and void. We may assign these Terms and any rights or obligations hereunder without your consent.
16.3 Severability
If any provision of these Terms is deemed unlawful, void, or unenforceable, that provision shall be deemed severable from these Terms and shall not affect the validity and enforceability of any remaining provisions.
16.4 Survival
The provisions of these Terms which by their nature should survive termination of these Terms shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
16.5 Entire Agreement
These Terms, including the Privacy Policy incorporated herein by reference, constitute the entire agreement between you and Teach Tappy concerning the Service and supersede all prior or contemporaneous communications, proposals, and understandings, whether electronic, oral, or written, between you and Teach Tappy with respect to the Service.
17. Subscription Amendment Rights
In addition to our rights to modify the Service as described in Section 13, we specifically reserve the right to:
- Change subscription pricing for future billing periods
- Introduce new subscription tiers, plans, or models
- Migrate users to equivalent plans if we discontinue existing subscription offerings
- Modify the benefits, features, or limitations associated with any subscription plan
- Change the payment processor or billing mechanism
- Offer, modify, or eliminate promotional pricing or trial periods
We will provide notice of any subscription changes through our website or by email prior to your renewal date. However, you agree that:
- Your continued use of the Service after such changes constitutes acceptance of the new terms
- It is your responsibility to review subscription details before each renewal period
- You understand that the Service and its features are subject to change
- No representation about future functionality constitutes a binding commitment
